Licensing Agreement

This document is a legal license between you and the company EFFIGIE.

When ordering and using photographs from EFFIGIE, you expressly agree to accept the terms of this license.

All the photographs are protected by copyright. Ownership of the photographs and any related rental rights remain with Iconotec, which is simply granting you a license for the use of the photographs.

This license, which is personal, non transferable and non exclusive, authorises you to use the photographs on any support, with the exception of regulated or prohibited use as specified below, for any type of operation such as the illustration of press articles, packaging, advertising, posting on the internet, or reproduction whether in print or in digital form as dictated by the needs of your use. This license has no time limit, unless you fail to comply with any of the clauses of this license.
This license authorises you to crop, reframe, touch up or use part of the photographs, and to extract, add or delete details from them.

The photographs may represent architectural buildings or monuments, works or objects, designs or trademarks, which are protected as follows:
copyright (articles L.111-1 to 132-33 of the code of intellectual property),
the right of personal portrayal and property (articles 9 and 544 of the civil code)
protection of designs (articles L.511-1 to L.521-4 of the code of intellectual property)
protection of trademarks (articles L.711-1 to L.716-6 of the code of intellectual property).
It is your responsibility to negotiate directly with the holders of such rights to obtain the authorisations required to use the photographs, depending on how you wish to use them.

Prior to using the photographs in any of the following cases, you must contact EFFIGIE and pay a supplementary license:

use of the photographs in a product intended for sale of which they constitute the principal value, such as postcards or posters.
for posting all or part of a photograph on a network whose access is by payment.

It is prohibited to copy or distribute copies of cd-roms, their documentation and packaging.

It is prohibited to use the photographs in a context which could be qualified as pornographic, political, defamatory, immoral, abusive or deprecatory.

The transfer of this license does not imply the transfer of ownership. The photographs are protected by copyright law. Consequently you must use the photographs as any other protected product. Any representation or reproduction, whether integral or partial, which is made without the consent of EFFIGIE is considered to be forgery and is punishable by three years of imprisonment and a fine of 300 000 euros in accordance with articles L.335-2 sqq. of the code of intellectual property.

This licence is governed exclusively by French law. Any dispute relating to its interpretation or execution shall come under the jurisdiction of the French courts.

Whenever you use the photographs, you must ensure that the rights of EFFIGIE are made visible as follows: “EFFIGIE/CD-PRESS”.

If the name of the photographer is printed on the photographs, it must not be deleted or modified.
